What You Need to Know

1. Terms & Conditions

Elements Yoga Studio reserves the right to vary and revoke these Terms and Conditions from time to time which it may consider necessary or desirable for the regulation of the internal affairs of the Studio and/or the conduct of Members. Any such changes will be published on the Website and, until revoked, are binding on Members.

2. Membership

2.1. Subject to condition 2.3, when a person has completed a Registration Form, a Medical Questionnaire/Disclaimer Form and purchased a Membership, they shall become a Member of Elements Yoga Studio subject to these Terms and Conditions.
2.2. Acceptance of a person as a Member is in the absolute discretion of Elements Yoga Studio.
2.3 “Membership” means the different types of Membership that a Member may purchase including but not limited to 5 Class Pass, Drop-In Session, Elements VIY Monthly Membership, Dedicated Yogi Memberships and Elements Explorer.
2.4. A person shall cease to be a Member when their Membership expires or when the Membership is terminated under these Terms and Conditions. For the avoidance of doubt the provisions of condition 4 shall continue to apply after a person ceases to be a Member.
2.5. For Class Passes and Drop-In Sessions, the relevant start date in determining that expiry date is the date that the Member first uses their Class Pass or Drop-In Session to attend a class and not (unless it is the same date) the date the Class Pass or Drop-In Session is purchased.
2.6 Elements Yoga Studio reserves the right to expel from the Studios, suspend for a specific period, terminate the Membership of or refuse to renew the Membership of any Member whose conduct is or may be, in Elements Yoga Studio’s reasonable opinion, damaging to the character of the Studio or amounts to a breach of these Terms and Conditions or where such expulsion is otherwise in the interests of the other Members. Any Member so expelled or that has their Membership or Class Passes terminated or suspended shall forfeit all privileges to Membership of the Studio and shall not be entitled to any refund.
2.7 An Elements VIY Monthly Membership and Dedicate Yogi Unlimited Member may attend unlimited sessions of any scheduled classes.
2.8 Details of prices of Memberships are available at the Studio or on the Website and shall be such prices as determined by Elements Yoga Studio from time to time.
2.9 Subject to any statutory right of cancellation, payments for Memberships and Classes are non-refundable unless otherwise stated in these Terms and Conditions.

3. Cancellation

3.1 Full payment for all classes is required prior to participation in the class. Drop-Ins and Class Passes are non-refundable and non-transferable.
3.2 All cancellations should be made online. Cancellations prior to 1 hours notice are credited to your Class Pass.
3.3 Cancellations made within 1 hours of class starting are non-refundable.
3.4 A £5 charge will be applied to Dedicated Yogi Unlimited, VIY Monthly Members and Elements Explorer Explorer pass holders that cancel a class giving less than 1 hours or that fail to show up to a booked class (‘No Show’).
3.5 All Class Passes are non-refundable, non-extendable and non-transferable. The date for which class memberships are valid depends on the type of purchase made. For Class Passes and Drop-In Sessions, the relevant start date in determining that expiry date is the date the Member first uses their Class Pass or Drop-In Session to attend a class and not (unless it is the same date) the date the Class Pass or Drop-In Session is purchased. 
3.6 Please note full payment for all workshops and events is required on booking and is not refundable. You may transfer your booking to another person provided that you inform us about the change in writing (email or text)
 
4. Monthly Autopay Membership
 
4.1 The provisions of this condition 3 shall only apply to a Member that applies for an Elements VIY Monthly and Dedicated Yogi autopay Memberships by debit card,  credit card or direct debit.
4.2 Any Member, who is purchasing classes by autopay, shall be entitled to participate in the number of classes specified in their membership contract until their auto pay terminates and any such Member will forfeit their membership if they fall behind in payment at the date due.  Such Member shall remain liable for any outstanding payments.
4.3 Autopay fees must be paid in accordance with these Terms and Conditions irrespective of whether or not the Member uses the Studios’ facilities.
4.4 Autopay fees may be increased at Elements Yoga Studio’s discretion. Members shall be given at least 30 days’ notice of any increase in subscription fees.
4.5 Any Member that is purchasing classes by autopay agrees that they cannot cancel their subscription before the expiry of the minimum period of 1 month from the date of their initial payment (“the Minimum Subscription Period”).
4.6 Subject to condition 4.4 and any right of Elements Yoga Studio to cancel or suspend the Membership, the Membership will continue indefinitely unless and until a Member cancels their Monthly Membership by written request to Elements Yoga Studio, giving five working days’ notice of the desired cancellation date. No refunds shall be given to Members in respect of any Subscription fees that have been paid.
4.7 Members agree and acknowledge that by agreeing to the Minimum Subscription Period, they are being given preferential rates by Elements Yoga Studio.
4.8 It is the responsibility of the Member to inform Elements Yoga Studio of a desire to cancel a membership within the required notice period. Elements Yoga Studio cannot be held liable for any payments processed due to the failure of a Member to cancel their membership.
4.9 Members who do not wish to accept a change proposed by Elements Yoga Studio to any subscription fees may cancel their subscription by giving 1 months’ notice. The Member giving notice must continue to pay subscriptions at the rate current immediately prior to any proposed increase until the end of such notice period.
4.10 If the subscription is paid by debit or credit card (or any Subscription fees remain outstanding beyond the due date) the Member unconditionally and irrevocably authorises Elements Yoga Studio to debit any credit or debit card provided by the Member with the monthly subscription fee (or any outstanding fees) without notice to the Member.
4.11 Members cannot suspend their membership at any time during their Membership. Members can cancel their membership with five working days’ notice.
 

5. Limitation of liability

5.1 In consideration of Elements Yoga Studio accepting a person as a Member, the Member agrees that:

5.1.1 Neither Elements Yoga Studio, nor its employees or contractors shall be liable for any death, personal injury or illness occurring in Members’ homes or upon the premises as a result of the online or in-studio teachings, and use of the facilities and/or equipment provided by Elements Yoga Studio.

5.1.2 Neither Elements Yoga Studio, nor its employees or agents shall be liable for any loss, damage or theft of any property (including bicycles) belonging to, or brought onto or left outside the premises by the Member or any guest of the Member.

5.1.3 Vehicles, bicycles and their contents, parked or locked up on or outside Elements Yoga Studio are left at the owners risk and Elements Yoga Studio will accept no liability for loss, damage or theft in respect thereof.

5.2 Without prejudice to condition 5.1.1, it is the Member’s responsibility to ensure that their physical condition is appropriate for participating in online and in-studio Classes and to ensure that they correctly operate or use any facilities and/or equipment provided by Elements Yoga Studio. If the Member is in any doubt as to how to correctly perform a posture they should consult a member of staff before class.

6. Use of facilities

6.1 A Member is entitled to use the Studio facilities provided always that the Studio may at any time withdraw all or part of its facilities or Classes for any period or periods and with notice, where practicable, in connection with any cleaning, repair, alteration or maintenance work or for reasons beyond the control of Elements Yoga Studio.

7. Fitness and Health

7.1 Each Member agrees to familiarise themselves with what Classes involve prior to assessing whether they are fit to participate in a Class. Members should refer to the Website or speak to a member of staff for further information.
7.2 Each Member warrants and represents on the date of their acceptance of these Terms and Conditions and on each occasion that the Member uses the Studios that the Member is in good physical condition and that the Member knows of no medical or other condition why the Member is not capable of engaging in the Classes or exercises provided by Elements Yoga Studio and that such Classes or exercises would not be detrimental to the Member’s health, safety or physical condition.
7.3 Elements Yoga Studio staff are not medically trained and are therefore not qualified to assess whether the Member or any guest is in good physical condition and/or that the Member can engage in any exercise without detriment to the Member’s health, safety, comfort or physical condition.
7.4 Members are advised not to undertake any physical activities without first seeking medical advice if they have concerns over their physical condition. Elements Yoga Studio reserves the right to refuse access to any Member if, in its absolute discretion, it considers that the health of the individual concerned may be endangered by the use of Elements Yoga Studio’s facilities.
7.5 Members shall not use Elements Yoga Studio’s facilities if they are suffering from: any infectious or contagious illness, disease or other ailment or suffering from any ailment where there is a risk, however small, that such ailment may be detrimental to the health safety, comfort or physical condition of the other Members. If there is any doubt, Members should consult their doctor and must notify Elements Yoga Studio of any circumstances affecting their health, which may be exacerbated through continued use of the Studio.
7.6 Members are responsible for informing Elements Yoga Studio staff and teachers of any change to their health that may impact their ability to practice Yoga.

8. Dress

8.1 Members are requested to wear comfortable clothing appropriate to the practice of Yoga.
8.2 Footwear should be removed in the corridor area before entry to the yoga room and placed in the pigeon-holes provided.
8.3 Members should not walk around the yoga room barefoot if they have verrucas or similar foot complaints.
8.4 There are no changing facilities at the Studio so please arrive suitably dressed.

9. Safety & Hygiene

9.1 In the interests of safety and hygiene, no crockery, glass, hot drinks or food are permitted in the yoga room. Only water is permitted in the yoga room in bottles.
9.2 Mats, blocks and bolsters are provided; however in the interests of safety and hygiene Members are required to bring a suitable towel to cover their yoga mat.
9.3 Members must use the main entrance to the Studio when entering or leaving. The fire exit is there in the interests of safety and Members must not interfere with these doors for any reason.
9.4 In the event of a fire, Members are asked to make their way to the nearest available exit.
9.5 Smoking is not allowed in the premises.
9.6 The Reception door will be locked during class

10. Etiquette & Personal Belongings

10.1 The use of mobile phones is not permitted in the Studio. Please ensure your mobile is switched to silent mode and left outside the yoga room in the pigeon-holes provided.
10.2 Please ensure you arrive 10 minutes before your class and remain quiet and respectful of other yogis once in the Studio.
10.3 The Yoga room is a silent space. Members may use the times before and after class for meditation. Members are encouraged to meet up and quietly chat in the reception area before and after class.

11. General

11.1 Details of Class times at the Studios may vary from time to time and are published on the Website. Elements Yoga Studio reserves the right to change Class times or cancel Classes at its discretion, and will endeavour to give Members notice of such changes as is reasonably practicable.
11.2 Members must at all times observe Elements Yoga Studio guidelines which may be notified to them from time to time and are requested to comply with any reasonable directions which the management of the Studio may issue to ensure the safety of the Members and the smooth operation of the Studio for the convenience of all Members.
11.3 Members are required to give written notice to Elements Yoga Studio of any change of address or email or update themselves via their online account.
11.4 Elements Yoga Studio reserves the right to refuse admission to the Studio.
11.5 Elements Yoga Studio reserves the right to refuse admission to classes if the student arrives past the start time for the class.

12. Business (and Data) Privacy Policy

This privacy policy sets out how Elements Yoga Studio uses and protects any information that you give Elements Yoga Studio when you use our website (and the registration form when you first come to a class at Elements Yoga Studio). We collect basic types of data including name, address etc as well as some medical histories pertinent to practicing Yoga.

Most of your information will have been provided by you using our software system completing our registration form. We also collect information from the technology you use when using our website, so we can monitor website pages visited.

Elements Yoga Studio is committed to ensuring that your privacy is protected. Should we ask you to provide certain information by which you can be identified when using this website, then you can be assured that it will only be used in accordance with this privacy statement.

Elements Yoga Studio may change this policy from time to time by updating this page. You should check this page from time to time to ensure that you are happy with any changes. This policy is effective from November 2018.

12.1  What we collect:

We may collect the following information:

  • name
  • contact information including email address
  • demographic information such as postcode
  • medical histories pertinent to practicing Yoga
  • other information relevant to customer surveys and/or offers

12.2  What we do with the information we gather

We require this information to understand your needs and provide you with a better service, and in particular for the following reasons:

  • Keep track of medical conditions that are important to your Yoga practise. This information can be viewed by our Yoga Teacher who must abide by our terms and conditions and data protection laws
  • Internal record keeping
  • We may use the information to improve our products and services
  • We may periodically send promotional emails about studio news, special offers or other information, which we think you may find interesting using the email address which you have provided
  • At no time will the information be sold, passed on or used to/by any external company

12.3  Security

We are committed to ensuring that your information is secure. In order to prevent unauthorised access or disclosure, we have put in place suitable physical, electronic and managerial procedures to safeguard and secure the information we collect online.

12.4  You are in control

You are able to control your account details. Please log into your account to make any changes.

12.5  How we manage your records

We manage our records to help us to serve our customers well, for example such as dealing with any queries relating to your account and to comply with legal and regulatory requirements. Records help us demonstrate we are meeting our responsibilities and to keep as evidence of our business activities.

12.6  Retention periods for records are determined based on the type of record.

Retention periods may be changed from time to time based on business or legal and regulatory requirements.

12.7  Your rights

You have a number of legal rights to control what we do with your information. For example, you can ask us:

  • to unsubscribe you
  • to tell you what information we have about you
  • for a copy of this information
  • to update or change it
  • to unsubscribe from marketing materials

12.8  Sharing your information

We use a customer relations management system that stores your data. This system is fully GDPR compliant and does not share (or sell) your information.

We also use an email database system that only stores your email address. This system is fully GDPR compliant and does not share (or sell) your information.

Elements Yoga Studio will never share (or sell) your information with any other persons/companies.

13. Assistance Dog Policy

At Elements Yoga Studio, we are committed to creating an inclusive and welcoming environment for all our students and teachers. We recognise that some individuals may require an assistance dog to enable access. Therefore, we have established this assistance dog policy to ensure that everyone can enjoy the benefits of yoga at our studio.

13.1 Definition of Assistance Dog:

Assistance dog, also known as a service dog, is a specially trained dog that assists individuals with visual impairments or other disabilities. These dogs are trained to perform specific tasks to enhance the independence and mobility of their owners.

13.2 Admission to Elements Yoga Studio:

We welcome assistance dogs and their handlers to our studio. Any student with an assistance dog is encouraged to inform our staff in advance to help us provide the best possible experience.

13.3 Responsibilities of Assistance Dog Owners:

Assistance dog owners are responsible for the following when bringing their assistance dogs to Elements Yoga Studio:

Maintain Control: Assistance dog owners must always keep their dogs under control to ensure the safety and comfort of all individuals in the studio.

Cleanliness: Assistance dog owners must ensure that their dogs are clean, groomed, and well-behaved. It is essential to keep the studio environment clean and free from any dog-related mess.

Behaviour: While we understand that assistance dogs may occasionally exhibit behaviours such as getting up or barking, we kindly request that handlers make every effort to ensure their dogs remain calm and settled during classes to minimise disruptions.

13.4 Reasonable adjustments:

Elements Yoga Studio will make reasonable adjustments to ensure that assistance dog owners can fully participate in our classes and activities. This may include reserving a suitable space within the studio and making other changes as necessary to ensure the comfort of both the assistance dog owner and other participants.

Assistance dogs are welcomed into the reception area, where a tether point and water are provided for their security and comfort. Our teachers will support the assistance dog owner into the studio if required.

13.5 Allergies and Sensitivities:

We recognise that some individuals may have allergies or sensitivities to dogs. In such cases, we will work to find a reasonable solution that accommodates the needs of all individuals involved.

13.6 Reporting Concerns:

If any student or teacher has concerns or encounters difficulties related to assistance dogs in the studio, we encourage them to bring these concerns to the attention of the Studio Owner(s) by contacting the studio by phone, text or email. We will work diligently to address any issues and find suitable resolutions.
